Please read this Privacy Policy carefully. In this Privacy Policy ("Policy"), we describe the information we collect, how we use it, and when and to whom we disclose it. This Privacy Policy is between you and Skip Davey LLC and applies to the Skip Davey mobile application and also the Skip Davey website. Skip Davey LLC is referred to in this Privacy Policy as “Company” or “we” or “us”. The Skip Davey mobile application, together with any successor app(s) will be referred to as the “App” and the Skip Davey website currently located at https://skipdavey.com/ together with any successor website, will be referred to as the “Site.” Finally, this Privacy Policy refers to the App and Site, together with any materials and services available therein, as the “Service” or “Services”.

By using the Services, you confirm that you have read and understood this Privacy Policy, and the Terms of Service (together referred to herein as the “Agreement”). The Agreement governs the use of the Services. Skip Davey will collect, use, retain, disclose, and delete the Personal Information consistent with the Agreement.

Capitalized terms not defined herein shall have the meaning provided in the Terms of Service. 

1. Information We Collect

How we collect and store information depends on how you access and use the Services. We collect information in multiple ways including when you provide information directly to us, when we collect information from affiliates and non-affiliated sources, and when we passively collect information from you, such as information collected from your browser or device.

Information You Provide Directly 

Skip Davey collects certain personally identifiable information about you, including information that can identify, relate to, describe, be associated with you, or is reasonably capable of being associated with you (“Personal Information”). Examples of Personal Information that we collect include but are not limited to:

Contact Information. This may include your first and last name, postal address, telephone number, and email address.

Promotional Information. Certain offerings of the Services, such as newsletters, surveys and contests are optional and so you are not required to enter them or to give us your data in connection with them. Where you do consent to participate in these offerings, we will use your data to (as applicable) send you communications that are tailored based on information we have about you, or to operate and manage the survey, contest or similar offering in connection with promoting our business and the Services. To opt-out of receiving marketing communications from us, please see the Your Rights and Choices section, below.

Submission Information. You also may choose to send us Personal Information in an email or chat message containing inquiries about the Services and we use this information to help us respond to your inquiry. We also collect content within any messages you exchange with other users through the Services (such as through our message board, comment, or chat functionalities).

We require that you furnish certain information when you register an account with us to provide the Services. For example, we collect your first and last name, email address, and your zip or postal code in order to create and administer your account. We also collect additional information to facilitate your request, such as information about the services you are seeking. If you are a providing a service through the Services, we collect your first and last name, email address, mobile phone number and zip or postal code to create and administer your account and facilitate communications between you and those users interested in your services. We also collect information about your services, rates, and skills.

Information We Collect Automatically


We automatically collect certain information when you use the Services. The categories of information we automatically collect include:


Service Use Data. This includes data about features you use, pages you visit, emails you view, portions of the Services that you view and interact with, the time of day you browse, and your referring and exiting pages.


Device Data. This includes data about the type of device or browser you use, your device’s operating system, your internet service provider, your device’s regional and language settings, and device identifiers such as IP address. When you visit and interact with the Services, we may collect certain information automatically through cookies or other technologies, including, but not limited to, the type of computer or mobile device you use, your mobile device’s unique device ID, the IP address of your computer or mobile device, your operating system, the type(s) of internet browser(s) you use, and information about the way you use the Services (“Device Information”). We may use Device Information to monitor the geographic regions from which users navigate the Services, and for security and fraud prevention purposes. 


Location Data. This includes imprecise location data (such as location derived from an IP address or data that indicates a city or postal code level). When you visit the Services via a native mobile application, we may use (with your consent when required under applicable law), GPS technology (or other similar technology) to determine your current location to determine the city you are located in and display relevant information. We will not share your current location obtained in this manner with other users.

2. How We Use Your Information

We collect and use information for business and commercial purposes in accordance with the practices described in this Privacy Policy. Our business purposes for collecting and using information include:

Cell Phone Numbers. We may use your cell phone number to call or send recurring text messages to you, using an autodialer or prerecorded voice, in order to provide you notifications about Listings, for marketing purposes (with your consent where required by law), and to administer the Services. Standard data and messaging rates may apply.  We may also message you via push notifications.

3. How We Share Your Information

We share the information we collect about you as described in this Privacy Policy, or as described at the time of collection or sharing, including as follows:

Service Providers. We share information with entities that process information on our behalf for our business purposes. We contractually prohibit our service providers from retaining, using, or disclosing information about you for any purposes other than performing the services for us. Our service providers provide us with the following support services: fraud prevention and detection, data analytics, marketing and advertising, website hosting, technical support, and to otherwise help us provide the Skip Davey Services. 

Promotions. When you voluntarily enter a sweepstakes, contest, or other promotion, we share information as set out in the official rules that govern the promotion as well as for administrative purposes and as required by law. By entering a promotion, you agree to the official rules that govern that promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other entities to use your name, voice, and/or likeness in advertising or marketing materials. We may occasionally contact you, if you want us to, with information about special events, activities, promotions, contests, submission opportunities, and programs. 

Other Users. Skip Davey facilitates contact between users and reserves the right to share your Contact Information with other users, or with the recipient user’s legal or other authorized representative, in order to: (1) facilitate or communicate the resolution of an investigation or dispute related to or arising from an interaction between two or more users of the Services; or (2) facilitate the performance of a Listing. This exchange of information is essential to the operation of the Services.

Note that your account on the Services consists of information about you and your business, and may include information such as photographs, skills, expertise, rates, feedback/rating information, and other information about you. This information in your account may be visible by all users and the general public. If you choose to post a Listing on the Services, the contents of your listing will be viewable to anyone who can use the Services.  

Legal Obligations. We may disclose your Personal Information to courts, law enforcement, governmental or public authorities, tax authorities or authorized third parties, if and to the extent required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with our legal or regulatory obligations; (ii) respond to a court order, warrant or subpoena; (iii) respond to a valid legal request relating to an investigation into alleged criminal or illegal activity; or (iv) respond to or address any other activity that may expose us to legal or regulatory liability.

Business Transactions. Skip Davey reserves the right to share information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale, or any other type of acquisition or business combination of all or any portion of our assets, or transfer of all or a portion of our business to another business.

4. Your Rights and Choices

You may opt-out of receiving promotional communications from us, including promotional communications related to the Services, and request the removal of your Personal Information from our databases, or deactivate your account, by logging on to the Site or App and clicking on the “Account” tab, or by contacting us.

Push Notifications. You have the option to receive updates and relevant offers via push notifications in your app. These notifications can be configured in the settings of your mobile device at any time.

Corrections to Account. You have the right to access, update, and correct inaccuracies in your Skip Davey account at any time by logging in and clicking on the “Account” tab. There, you can view, update, and correct your Account information.

Promotional Communications. You can opt out of email marketing by clicking on the unsubscribe link in any message. You can opt out of promotional communications from Skip Davey sent via text message at any time by following the instructions provided in those messages to text the word "STOP". Please note that your opt-out is limited to the phone number used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. Even if you opt-out of receiving promotional communications, we may continue to send you non-promotional communications, such as those about your account, Listings, transactions, servicing, or messages related to our ongoing business relationship with you. 

5. Data Retention Policy

We keep the categories of Personal Information described above in this Privacy Policy for as long as is necessary for the purposes described in this Policy or as otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

Where Personal Information is collected and used for more than one purpose, we will retain it until the purpose with the latest period expires.

6. Data Security 

The security and confidentiality of your Personal Information is important to us. We have implemented commercially reasonable technical, administrative, and physical security measures to protect your Personal Information from unauthorized access or disclosure and improper use. It is important for you to protect against unauthorized access to your account password and to your computer. Be sure to log out of your account or to close your browser after you have completed your visit to our Services. Please note that despite our reasonable efforts, no security measure is perfect or impenetrable, therefore we cannot guarantee the absolute security of your Personal Information.

8. Children’s Privacy

We do not knowingly collect any information from anyone under 18 years of age. The Services we offer are all directed to users who are at least 18 years old or older. If you are under the age of 18, you are not authorized to use the Services.

9. International Visitors

Skip Davey operates and is based in the United States. If you are using our Services outside the United States, please be aware that the information described in this Policy may be transferred to, or processed and stored in, the United States and other countries, which may employ greater or less restrictive data protection laws. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the United States or other countries may be different from the laws in your country. In all cases, we will take appropriate measures to protect your personal information in accordance with the standards described in this Policy.

10. Changes

If we change this Policy, we will post those changes on this page and will modify the “Last Updated” date at the top of this Policy. If we materially change this Policy in a way that affects how we use or disclose your Personal Information, we will notify you by prominently posting a notice of such changes before making them.
